I would hope that none of us are shocked that the current AAG Christine Varney was likely engaging in "cheap, deceptive and misleading rhetorical tricks" when she purposely misrepresented Richard Posner's remarks about the "Chicago School." I don't know about you or the rest of your readers, but I fully expect dogs to bark and water to run down hill. I also expect Democratic administrations especially to take their regulatory responsibilities seriously and not let traditional economic analysis or a slew of historical enforcement blunders stand in the way of a more activist antitrust policy. No, what would really shock me is a wider recognition within the "antitrust establishment" that Varney's remarks are all part and parcel of an inevitable antitrust politics; that even the Chicago School analysis(basic microeconomics) cannot capture all that is wrong with traditional enforcement; and that the only way to make real and permanent progress is to push for the explicit repeal of specific antitrust statutes.
