I'm not an attorney, but it's my view that Jon Huntsman will wait for the trial in Texas, rather than settle for anything short of $2B plus all expenses incurred by Huntsman in this matter, plus interest on the $2B from date Hexion refused to close the deal. Jon Huntsman believes in the LAW, and this case is all about the supremecy of contract law in any business deal. It's just that simple. When a party to a legal contract, (that is one which embodies all the elements of a contract that must be satisfied to make it legal),fails to honor the expressed terms of the contract, there will always be consequences. Some will be spelled out in the contract, itself, but others will be decided in a court of equity. That's the Texas court case. Huntsman will win that case easily, and a jury of ordinary folks will award Huntsman damages equal to the full value of the proposed merger agreement, plus all costs of trial, etc. It's just that simple.

If the settlement is going to be close to 3 billion, it might just end uot hexion will handed over to huntsman for free.
2 or 3 billion is probably the networth of hexion in current market circumstances. That would create a great company with a lot lesser debt to service. In current enviroment that would a good solution. Maybe not for appollo/Leon Black. But they where served great in the past years with the hexion leaveriged construction.
